1. Introduction
Welcome to Work Safety. These Terms of Use ("Terms") govern the relationship between you, the user, and Barkai S. Safety Ltd., Company No. 515782050 ("the Company"), which operates the Work Safety system ("the System").
The System is designed for managing workplace and traffic safety at construction, paving, infrastructure and road sites. Use of the System constitutes full agreement to these Terms. If you do not agree to these Terms, please refrain from using the System.
2. Definitions
For the purposes of these Terms:
- "The System": The Work Safety platform, including the website worksafety.io, the field application (PWA), API interfaces, and all related services.
- "The Company": Barkai S. Safety Ltd., Company No. 515782050, Moshav Ilaniya, Israel.
- "Client": A company, business or organisation that has entered into a service agreement with the Company to use the System.
- "Subcontractor": A contractor working for the Client and using the System through their account, according to assigned permissions.
- "User": Any person who has been granted access to the System through a username and password, including managers, safety officers, inspectors and contractors.
- "Worker": A person whose personal details are managed in the System for safety purposes, even if they are not a direct System user.
- "Content": Any information, data, document, image, report or file entered, uploaded or generated within the System.
- "Service Agreement": The separate agreement between the Company and the Client defining the scope of service, quotas and payment terms.
3. The Service
3.1 System Description
The System provides digital tools for managing workplace and traffic safety, including but not limited to:
- Management of work sites, contractors and employees
- Safety and traffic inspections using customisable digital forms
- Defect management, corrective action tracking and automatic escalations
- Safety training management, written summaries and digital signatures in 7 languages
- Work equipment, vehicle and safety equipment management, including inspection validity tracking
- Automatic PDF report generation and distribution to mailing lists
- Automatic alerts via email, WhatsApp and in-app notifications
- Dashboard and BI reports for management monitoring
- Daily site log for documenting site activity
- Field application (PWA) for inspections, QR scanning and photo documentation
3.2 Regulatory Compliance
The System has been designed to assist in complying with Israeli safety regulations, including the Safety at Work Ordinance, the Organisation of Work Inspection Regulations, the Construction Safety Regulations and the Personal Protective Equipment Regulations. However, use of the System does not replace professional safety advice or legal counsel. The Client and its appointed safety officer bear sole responsibility for ensuring legal compliance at their sites.
4. Registration and User Account
4.1 Account Creation
User accounts are created by the Client's company administrator or by the System administrator. Usernames are unique and cannot be changed after creation. The Company reserves the right to reject an account creation request at its discretion.
4.2 Account Responsibility
The User is solely responsible for maintaining the confidentiality of their password. Login credentials must not be shared with any other person. All actions performed under a User's account are deemed to have been performed by that User. Any suspected unauthorised use of an account must be reported to the Company immediately.
4.3 Account Security
The System implements security measures including: automatic account lockout after 5 failed login attempts, password encryption (bcrypt), session management with automatic timeout, and logging of all login activity in the security audit trail.
5. Permission Levels and Access Control
The System operates on a Role-Based Access Control (RBAC) model. Each user is assigned permissions according to their role:
- Super Admin: Full access to all data and system settings. Restricted to Company staff only.
- Company Administrator: Full access to their own company's data, including user, site and contractor management.
- Safety Officer / Inspector: Access to perform inspections, manage defects and document training according to assigned permissions.
- Site Manager: Access limited to the specific site assigned to them.
- Contractor: Access to their own relevant data only.
The Company Administrator is responsible for defining appropriate permissions for each user and updating them as roles change.
6. Quotas and Payment
6.1 Usage Quotas
System usage is subject to quotas defined in the Service Agreement, including: number of work sites, number of active users, number of contractors and number of workers. Exceeding quotas will be automatically blocked by the System. Quota expansion is available in coordination with the Company and subject to updated payment terms.
6.2 Payment
Payment terms, including pricing, billing cycle and payment method, are defined in the separate Service Agreement between the Company and the Client. Non-payment may result in suspension of access to the System until the outstanding balance is settled.
7. User Responsibilities
Users agree to:
- Use the System solely for workplace and traffic safety management purposes as described in these Terms.
- Enter accurate, current and complete information. Incorrect data may compromise worker safety and regulatory compliance.
- Not attempt to access data belonging to other companies, sites or users outside their authorised scope.
- Not copy, reproduce, distribute, modify or reverse-engineer the System or any part thereof.
- Not upload content that infringes copyright, violates any law or regulation, or is offensive.
- Report immediately to the Company any security vulnerability, bug or weakness discovered in the System.
- Not use the System in any way that could impair its performance, availability or security.
8. Data Isolation and Multi-Tenancy
The System operates on a Multi-Tenant architecture with complete data isolation between clients. Each client can view only their own data and that of their associated subcontractors. There is no cross-access between different companies.
Company staff (Super Admin) may access client data solely for the purpose of technical support, maintenance, fault diagnosis and ensuring System integrity. Such access is recorded in the System's audit log.

9. Intellectual Property
9.1 Company Rights
All rights in the System, including source code, design, logos, trade names, algorithms, database structure and original content, belong exclusively to the Company and are protected by intellectual property laws.
9.2 Client Rights
Data entered by the Client and its users belongs to the Client. The Company holds such data as a "database holder" only and will not use it for any purpose beyond providing the service, except for aggregated and anonymous statistical data.
9.3 Licence
The Client receives a limited, non-exclusive, non-transferable licence to use the System in accordance with the Service Agreement and these Terms. This licence does not grant the Client any rights in the System beyond the permitted use.
10. Service Availability and Maintenance
10.1 Availability
The Company will endeavour to provide continuous and reliable service. However, planned service interruptions may occur for maintenance, security updates or upgrades. Advance notice of planned interruptions will be provided to clients when possible.
10.2 Force Majeure
The Company shall not be liable for service interruptions resulting from circumstances beyond its control, including: internet network failures, cyber attacks, natural disasters, widespread power outages, government actions or any force majeure event.
11. Backups and Data Export
11.1 Backups
The System performs encrypted automatic backups daily. Backups are retained for 30 days. The Company takes reasonable measures to maintain backup integrity but is not liable for data loss in the event of an extraordinary failure.
11.2 Data Export
The Client may export their data from the System at any time using the built-in export tools. Periodic data export is recommended as an additional backup.
12. Limitation of Liability
12.1 As-Is Service
The System is provided "AS IS". The Company does not warrant that the System will be free from faults, errors or interruptions. The Company makes every effort to resolve issues within a reasonable timeframe.
12.2 Limited Liability
In any event, the Company's liability to the Client is limited to the total amount paid by the Client for the service in the 12 months preceding the event giving rise to the claim. The Company shall not be liable for indirect, consequential, special or punitive damages, including loss of profits, loss of data or reputational harm.
12.3 Tool, Not Substitute
The System is a management tool and does not replace a qualified safety officer, professional advice or legal counsel. The Client bears sole responsibility for ensuring that safety activities at its sites comply with all applicable laws, whether using the System or otherwise.
13. Field Application (PWA)
The field application enables inspections, photo documentation, digital signatures and QR scanning directly from the field. The application works offline, and data synchronises automatically when connectivity is restored.
The User is responsible for ensuring that their device is up to date, password-protected, and that the browser application is updated to the latest version. The Company is not responsible for issues arising from the use of unsupported devices or outdated browsers.
14. Digital Signatures
The System enables digital signing of safety summaries and training documents. A digital signature records: the signer's name, ID number, date and time, IP address and device information. The User acknowledges that a digital signature in the System constitutes a binding record equivalent to a handwritten signature on a physical document.
15. Service Termination
15.1 Termination by Client
The Client may discontinue use of the System at any time by providing written notice to the Company. Termination takes effect at the end of the current billing period.
15.2 Termination by Company
The Company may suspend or terminate access to the System in the following cases: breach of these Terms, prolonged non-payment, unlawful use, or use that damages the System or other users. In the event of immediate termination, the Company will notify the Client and provide a reasonable opportunity to export their data.
15.3 Data After Termination
Upon service termination, the Client's data will be retained for an additional 30 days for export purposes. After 30 days, data will be permanently deleted, subject to mandatory legal retention requirements (for example, safety training records required to be kept for 7 years).
16. Indemnification
The Client agrees to indemnify the Company, its directors and employees against any damage, loss, expense or claim arising from a breach of these Terms by the Client or anyone acting on its behalf, or from unlawful use of the System.
17. Changes to Terms and System
17.1 Changes to Terms
The Company may update these Terms from time to time. Material changes will be published in the System interface and sent by email to account administrators at least 14 days in advance. Continued use of the System after publication of changes constitutes acceptance of the updated Terms.
17.2 Changes to the System
The Company may update, improve or modify the System, including adding features, removing features or changing the user interface. The Company will endeavour to provide advance notice of material changes.
18. Notices
Any notice in connection with these Terms shall be sent by email: from the Company to the Client, to the email address registered under the Company Administrator account; from the Client to the Company, to info@worksafety.io. A notice shall be deemed received on the first business day following its dispatch.
19. General
- These Terms, together with the Service Agreement and Privacy Policy, constitute the entire agreement between the parties.
- A waiver of any right shall not be deemed a continuing waiver or a waiver of any other right.
- If any provision of these Terms is found to be unlawful, the remaining provisions shall remain in full force and effect.
- The Client may not assign its rights or obligations under these Terms to a third party without the Company's prior written consent.
20. Governing Law and Jurisdiction
These Terms are governed exclusively by Israeli law. Exclusive jurisdiction for any dispute arising from these Terms is vested in the competent courts of the Central District, Israel.
